Terms of Personalised Song

1. About the service

Personalised Song, at https://personalisedsong.nz, lets you order a personalised digital song from the information you provide. This is an online service; the domain does not establish a New Zealand company or office.

2. What you receive

You share a story and choose the language, mood, musical style and voice preference. We create lyrics, music and vocals using automated technology, including artificial intelligence. A completed order includes the recording, its lyrics, an MP3 download and a Song Page with an online player.

The song is usually ready about 10 minutes after payment confirmation. This is an estimate, not a guaranteed delivery time. You need internet access, a current browser and a working email address.

3. Ordering and payment

Prices on this storefront are in New Zealand dollars (NZD). The total payable is shown before payment; any optional second version or karaoke is priced before its separate purchase. There is no subscription or recurring charge. Payments are processed by Stripe and an order is confirmed when payment is completed.

The displayed total is the amount charged by the service. Your bank may apply its own charges. These Terms do not represent that the operator is registered for New Zealand GST or that a particular GST treatment applies.

4. Creation and delivery

Check names, spellings and important facts before ordering. Your story is the basis of a creative adaptation, so every sentence or detail may not be reproduced word for word. The finished recording, lyrics and MP3 are made available on the Song Page, with the link sent to your order email.

If a technical problem prevents creation or delivery, we will take reasonable steps to fix it or deliver the song again. Free manual edits and unlimited new versions are not included unless the offer expressly says otherwise.

5. Generated content

Generated songs may contain unusual pronunciation, unexpected wording or differences from the sound you imagined. A style or voice preference is a creative direction, not a promise of a particular performer or an imitation of an artist.

Disliking a melody, arrangement or voice does not by itself mean that a correctly described and supplied song is faulty. This does not limit your rights where the service is defective, misdescribed or fails applicable consumer guarantees.

6. Cancellation, complaints and refunds

If you need to cancel, contact us promptly; creation may already have begun. A change of mind about a correctly supplied personalised result does not automatically entitle you to a refund. Personalised or digital content is not subject to a blanket exclusion of statutory remedies.

Where applicable, the Consumer Guarantees Act 1993 requires reasonable care and skill, fitness for an agreed purpose and completion within the agreed or a reasonable time. If those guarantees are not met, you retain the remedies the law provides, which may include correction, cancellation, a refund and compensation. Nothing in these Terms excludes mandatory rights under that Act, the Fair Trading Act 1986 or other applicable law.

If a paid song cannot be delivered for an unresolvable technical reason, the relevant payment will be refunded. Send faults, order mismatches or complaints to [email protected]. We aim to reply within 14 days without limiting statutory deadlines.

7. Your rights to the song

You may listen, download the MP3, share it with family or friends, play it at a private celebration and use it in a private, non-commercial video. Resale, advertising and other commercial use require separate permission.

We do not guarantee exclusivity or that every element of generated content qualifies for copyright protection. This permission does not grant rights in third-party material submitted without authorisation.

8. Material you provide

Only submit stories, photographs and other material you are entitled to use. Do not provide unlawful content or infringe another person's rights, reputation or privacy. Share only relevant personal information about other people and ensure you are entitled to provide it.

9. The Song Page

Anyone with the unique Song Page link can open it without an account or password. It is marked not to be indexed by search engines, but this is not access protection. People holding the link can also access the available personalisation controls; share it carefully.

The existing free personalisation options allow one photograph replacement and one change each to the title and dedication. They do not change the audio. Download and keep your MP3; indefinite page hosting is not guaranteed.

10. Service availability

The service depends on external technical providers and can experience interruptions or delays. We will take reasonable steps to restore access and complete paid orders. This does not exclude liability or remedies that cannot lawfully be excluded.

11. Final provisions

These Terms do not take away protection under mandatory law applicable to you, including New Zealand consumer law where it applies. They do not impose exclusive UK jurisdiction. Changes do not affect orders already paid for; the current version is available on this page.
